Brandsmiths are in the UK Supreme Court for the second time this year in a trade mark case against marketplace giant Amazon. We are representing Lifestyle Equities (Beverly Hills Polo Club) over territorial intellectual property rights.
“We use online shopping all the time and you can buy goods from other countries and have them shipped to you. But IP rights only relate to the territory in which they’re registered. There’s naturally that tension for a business which trades online. To what degree should they respect IP rights in other jurisdictions?”
